Are Disposable Vapes Legal in the UAE? The 2026 Rules in Plain English

By DK Ridoy, Vape Highster UAE · Published 25 October 2026 · Last updated 25 October 2026 · Rules checked against official sources in October 2026

Short answer: Yes. Disposable vapes are legal to buy and use in the UAE for adults aged 18 and over. The UAE legalised e-cigarettes in April 2019. Each product has to meet the UAE.S 5030:2018 standard and carry conformity approval from the Ministry of Industry and Advanced Technology (MoIAT). Vapes carry 100% excise tax, and vaping is banned in enclosed public places.

We sell disposables in Dubai, so we have a stake in this answer. That is also why we read the rules closely. Nothing on this page is legal advice; where a rule matters to you personally, check it with the authority named next to it.

How did vaping become legal in the UAE?

Electronic cigarettes became legal to sell in the UAE in April 2019, when the federal standard UAE.S 5030:2018 for electronic nicotine products took effect. The standard sets product, safety and labelling requirements for vapes and e-liquids. Conformity is assessed under the Emirates Conformity Assessment Scheme (ECAS), now run by MoIAT.

Four dates explain most of what you see on shelves today:

Date What changed Who set it
2009 Federal tobacco control law bans sale to under-18s and smoking in enclosed public places Federal Law No. 15 of 2009
April 2019 E-cigarettes legal to sell, subject to the UAE.S 5030:2018 standard ESMA, now MoIAT
December 2019 100% excise tax applied to vape devices and e-liquids Federal Tax Authority, Cabinet Decision No. 52 of 2019
1 September 2026 Minimum excise price of AED 1 per ml for vape liquids, with or without nicotine Cabinet Decision No. 137 of 2026, Ministry of Finance

Before 2019, vapes were sold anyway, quietly, and the old Khaleej Times reports describe shops having stock confiscated. If you hear an older resident say “vapes are illegal here,” that memory is the reason.

Who can legally buy a disposable vape in the UAE?

Anyone aged 18 or over. Article 5 of Federal Law No. 15 of 2009 on tobacco control prohibits selling, or attempting to sell, tobacco products to anyone under 18. The UAE Ministry of Health and Prevention has stated publicly that e-cigarettes fall under this law. Sellers who break it face fines, and the shop, not the buyer, carries that risk.

Some UAE retailers set their own age limit at 21. That is a store policy. The federal line is 18.

If you’re buying from us, our age restriction policy sets out how we handle it.

What makes a specific disposable legal to sell?

A disposable is legal to sell in the UAE when it meets UAE.S 5030:2018 and its importer has completed MoIAT conformity under ECAS. The standard also governs labelling, including health warnings and a statement that the product must not be sold to or used by anyone under 18. Legality attaches to the product, not just the shop.

That last point catches people. A licensed shop can still stock a grey-import device that never went through conformity.

You, as a shopper, can’t see a conformity certificate on the box. What you can check:

  • Health warnings on the pack, including the under-18 notice
  • A seller with a physical UAE presence and a trade licence you can ask about
  • Specs on the box that match the brand’s own published specs
  • No THC, CBD or cannabis-derived liquid of any kind (more on that below)

The tax stamp myth

You’ll read online that every legal vape in the UAE carries a digital tax stamp, and that a missing stamp proves a fake. That isn’t how the UAE scheme was built. The Federal Tax Authority’s digital tax stamp scheme was rolled out for cigarettes, then water pipe tobacco and electrically heated tobacco sticks. Vapes and e-liquids are excise-taxed at 100%, but business-setup advisers in Dubai describe them as sitting outside the tobacco stamp scheme.

So don’t bin a disposable just because you can’t find a stamp on it. Judge it on the checks in the section above. And if a seller tells you their stamp proves anything about a vape, ask them which FTA rule they mean.

What does the 2026 minimum excise price change?

From 1 September 2026, Cabinet Decision No. 137 of 2026 sets a floor of AED 1 per ml on the excise price of liquids used in electronic smoking devices. The 100% excise rate itself didn’t change. What changed is the minimum value the tax is calculated on, and it applies to 0mg liquids as well as nicotine ones.

WAM, the UAE state news agency, reported the decision in August 2026.

For shoppers, the practical effect is on cheap, high-volume liquid. If you’ve noticed big bottles or very large-tank devices moving in price since September, this is the most likely reason. How each importer applies the floor to prefilled devices is a question for their tax adviser, not for a shop blog, so we won’t guess at it.

Where can you vape in the UAE?

Vaping follows smoking rules. Under Federal Law No. 15 of 2009 and Cabinet Decision No. 24 of 2013, smoking, vaping included, is banned in enclosed public places such as malls, cinemas, offices and public transport. It is also banned in a private car with a child under 12. Designated smoking areas are allowed where they meet ventilation rules.

In practice, in Dubai, that means the smoking rooms in malls and airports, outdoor terraces where smoking is permitted, and your own home. Individual buildings and employers can be stricter. A tenancy contract that bans smoking indoors covers vaping too, unless it says otherwise, so read yours before you assume.

Fines for vaping in a prohibited place are reported at AED 500 for a first offence. Repeat offences cost more.

What is still illegal, without exception?

Any vape liquid containing THC, CBD or other cannabis-derived substances. These fall under UAE narcotics law, not tobacco law, and the penalties are in a different league from a smoking fine. Liquids that are legal in parts of Europe or North America are not legal here.

Bringing one in “for personal use” doesn’t change that. Neither does a foreign prescription.

If you’re flying in or out with an ordinary nicotine vape, the battery and airline rules are covered in our vaping and travel guide.

Is it legal in every emirate?

Yes. The age limit, product standard and excise tax are federal, so they apply the same way in Dubai, Abu Dhabi, Sharjah, Ajman and the other emirates. Local authorities can add rules on where you smoke, but they can’t make a federally legal product illegal to own. We deliver to all seven emirates: Dubai within 1 to 2 hours, Sharjah and Ajman the same day, and the rest within 24 hours.

Disposable vape laws in the UAE: FAQ

Are disposable vapes legal in Dubai?

Yes, for adults 18 and over, as long as the product meets the UAE standard. You can’t vape in enclosed public places such as malls or the Metro.

Can tourists vape in the UAE?

Yes. The same rules apply to visitors as to residents. Nicotine vapes are fine; anything containing THC or CBD is not.

Is 0mg vape liquid taxed in the UAE?

Yes. Cabinet Decision No. 137 of 2026 covers liquids used in electronic smoking devices whether or not they contain nicotine, so 0mg liquids carry excise tax too.

Can I vape in my car?

Yes, unless a child under 12 is in the car. Federal Law No. 15 of 2009 bans smoking in a private vehicle with a child under 12 present.

Are disposable vapes safe?

Disposable vapes contain nicotine, which is addictive, and they aren’t for non-smokers, anyone under 18 or pregnant women. A shop isn’t the right source for health advice. Ask a doctor, or check the guidance from the UAE Ministry of Health and Prevention.
